To: Customers Damaged by Memory Mix Up


As of today (9-15-06) Toshiba is still advertising the wrong type of Memory for the vast majority of Laptops on their "Toshiba Direct" website.  [UPDATE: Almost two months later, after multiple complaints, Toshiba is STILL advertising and selling incompatible memory for their laptops]

They list both DDR and DDR-2 memory chips ( 256, 512, and 1G) as being compatible with each Laptop, which is physically impossible!  I have no idea how long they have been doing this, but judging from the LONGGGGG list of VERY unhappy customers, it looks like they have been playing this game for awhile!   Even the salespeople in their direct telephone sales division ship the wrong memory if you call in your order.

After removing however many hundreds of dollars from the customer's bank account, Toshiba ships the wrong memory, then makes it EXTREMELY difficult for the customer to get a refund. They also expect the customer to pay the original postage for the useless memory being peddled by their salespeople and on their website. After the customer spends days making phone calls and sitting on hold, Toshiba informs the customer she will not get a credit until Toshiba issues a return ticket for the useless merchandise and it is returned.  Only after Toshiba choses to acknowledge receipt of the erroneous memory THEY shipped will the customer get a refund.  

How long this takes is anyone's guess? 

THIS IS WRONG!!!  How much in interest alone is Toshiba earning by holding the customer's money until Toshiba gets around to correcting THEIR OWN MISTAKE?? How many customers are they doing this to?  Why does Toshiba think customers should do without the cash Toshiba TOOK from them until Toshiba can unravel the mess they have created?  How many customers are going to be suckered into purchasing the wrong memory by Toshiba's false claims on their website and in their phone sales division?  Why should the customer PAY because Toshiba sales can't tell what kind of memory goes into THEIR OWN LAPTOPS!!  How long before Toshiba stops claiming that both DDR and DDR-2 DIMMs will fit in the SAME Toshiba laptop?  How many people have been, and will be, screwed by Toshiba because they don't know the difference between DDR and DDR-2 and depended on Toshiba to tell them what memory was compatibly with their Toshiba Computer?

Toshiba needs to be held accountable for the damages incurred by affected customers during the period Toshiba advertised, sold and shipped incompatible memory for their Laptops on both their website, and in their telephone sales division!

These damages include, but are not limited to:

Any and all costs associated with the customer's inability to access any funds transfered to, or placed on hold, by Toshiba.
Any and all costs associated with the customer's effort to correct Toshiba's mistake, including lost time, laptop productivity, etc.
Anything else a good lawyer can think of!!!
